A St. Paul man was charged Friday with conspiring to rob his neighbor, who was fatally shot.

Harold T. Hill, 53, lived next door to the victim, Roy Burgess, 50, according to a charge of conspiracy to commit a felony filed in Ramsey County District Court.

According to the complaint: Hill and Burgess were partners in selling heroin. Burgess had a habit of keeping money on him, and was presumed to have had about $5,000 to 6,000 in cash from a recent sale.

The suspected shooter, Andre T. Johnson, 42, and his mother, Johnetta Johnson, were at Hill's house on July 6 and told Hill they were going to rob Burgess because Andre T. Johnson needed money. Hill said, "OK," according to the complaint. Hill and Johnetta Johnson are cousins.

Burgess was away from his home, but lost his heroin and returned to get more, the complaint said. Andre Johnson allegedly fatally shot Burgess shortly before midnight at his home in the 400 block of E. Arlington Avenue, and allegedly wounded another person in the buttock.

"Hill said he agreed, but he never meant for Burgess to get robbed," the complaint said. Hill was at his home when Burgess was shot.

Johnson was charged Thursday with second-degree murder and second-degree assault.
